Trademark rights in the United States are based on when you first use a trademark in commerce.  Federal trademark rights are based on when you file for and obtain a federal trademark registration.  While you can have state or common-law trademark rights, a federal registration can trump those rights.

What Is a Trademark Clearance Opinion?

A trademark clearance opinion is a legal opinion formed after a comprehensive analysis of any pre-existing trademarks for similar or related goods/services.  The main purpose of a trademark clearance opinion is to identify any concerns or potential obstacles to your proposed USPTO federal trademark application, by looking at similar trademarks.  Because of the fact that in the United States we can have federally registered trademarks, state registered trademarks, and so-called "common-law" trademarks (ie. unregistered trademarks), a trademark clearance opinion will be interested in identifying any near matches or conflicts at any of those levels, as well as researching prosecution histories at the USPTO.

Clearance Opinions are always conducted on the basis of searches that are undertaken to identify any exact matches or near matches for your chosen trademark.  A pre-existing trademark need not be identical to pose a risk or conflict, as phonetic equivalents and near matches can also be the basis of a likelihood of confusion refusal.  A comprehensive search of the United States Patent and Trademark Office (USPTO) resources for similar marks is fundamental. Additionally, businesses should conduct online searches across various platforms, including state business registries and social media, to identify any conflicting marks.

  • Basic Search:  Some clients are only concerned about pre-existing federal trademarks.  In that case, a basic search (limited to the USPTO's database) may be sufficient to provide an opinion (usually called a "Knock Out Opinion," albeit one that is more limited than a full clearance opinion.  
  • Comprehensive (Full) Search:  A comprehensive or full search involves searching not only the USPTO database, but also the state registries, and common-law unregistered uses of trademarks.  A full trademark clearance opinion can thus be produced, identifying not only risks of conficlts that can be raised by the USPTO examiner attorney, but also risks of oppositions or ability to conduct commerce across the US.
