Trademark Renewal Services
We know that your trademark registration is a valuable asset that defines your brand and that it took significant time and money to obtain the trademark. However, in order to keep your valuable trademark registration, you need to periodically file documentation to renew that registration. It is imperative to be aware of and comply with the renewal filing deadlines to avoid cancellation of your trademark registration. At the same time, the procedures and process at the United States Patent and Trademark Office (USPTO) surrounding renewal can be confusing and frustrating, and a failure to timely and properly file your renewal documentation can lead to the cancellation of your trademark registration. Our law firm is versed in trademark law and the renewal process. We regularly assist clients located across the US (and even those based internationally) with the renewal process, making it a much more stress and headache-free experience. Rather than attempting to do it yourself, why not check out our trusted trademark renewal services? We provide trademark renewal services at an affordable flat fee, and work with small and medium-sized businesses in many different industries. We're here to take the burden off your shoulders so you can focus on what matters most—your business.
Understanding the Trademark Renewal Timeline
So long as you continue to use your trademark and comply with USPTO renewal filing deadlines, your trademark registration can last forever or at least a very long time. The first required renewal filing is due between the 5th and 6th anniversaries of your trademark registration. At that time, you will need to prepare and file a Section 8 declaration affirming that you are still using the trademark for the same good and/or services as in the registration, or declaring an excusable non-use (with an intent to resume use). You will also need to prepare and file a specimen for each registered class, demonstrating that you are still using the trademark. There is a 6 month grace period, during which you can, in essence, file late and still maintain the registration.
The next renewal filing becomes due between the 9th and 10th anniversaries. At that time you will need to prepare and file a Section 8 and Section 9 declaration affirming that you are still using the trademark for the same good and/or services as in the registration, or declaring an excusable non-use (with an intent to resume use). You will also need to prepare and file a specimen for each registered class, demonstrating that you are still using the trademark. There is a 6 month grace period, during which you can, in essence, file late and still maintain the registration.
Thereafter, you will need to file a Section 8 and Section 9 declaration to renew your trademark registration every 10 years.
If you fail to file during either the scheduled renewal period or within the 6 months automatic grace period, your registration will be canceled.
Our law firm team is well-versed in trademark law and renewal processes, ensuring nothing is overlooked.
Understanding the Trademark Renewal Filing Fee
The USPTO requires a filing fee for each renewal filing that you make. That filing fee will depend on the number of classes for which you are renewing your trademark registration. If you do not pay the filing fee, the USPTO will not accept your renewal filing. If you are filing during the 6 month grace period, there is an additional filing fee.
The USPTO periodically adjusts the filing fees, so it is important to check the current fee.
Understanding the Optional Section 15 Declaration of Incontestibility
At the time of renewal, there is an optional additional filing under Section 15 to have your trademark declared incontestable. An incontestable mark strengthens the protections afforded to you. For instance, a Section 15 declaration makes a mark immune from challenge except if it has become the generic term for the goods or abandoned for nonuse, or if the registration was acquired under fraudulent conditions. In order to achieve incontestability, a Declaration of Incontestability must be filed containing the requirements as provided in Section 15 of the Lanham Act. When a mark has been in continuous use for five years after being placed on the Principal Register, it may be classified as incontestable, or immune from legal challenge.
Our law firm understands the process and can assist you in determining if you meet the criteria to file for a Section 15 Declaration of Incontestability and help you understand if the rights afforded are of benefit to you.
